The Regular meeting of the Town Board of the Town of
Masonville was called to order at 7:30 P.M.

MINUTES:
Motion by Vince Warner to accept minutes as presented,
seconded by George Denys, all in favor carried.
FLOORTIME:
- Dean
Frazier- Commissioner of Delaware County Department of Watershed affairs
gave a presentation on the limited use of lands in the Watershed. NY City
is trying to acquire 50% of Delaware County Lands. Dean discussed the
ramifications on the DEP/DEC land acquisition program.
- Joann
thanked Duane for finishing the painting on the end of the highway
garage.
- Michael
Esposito asked about the State Police presence in Town. He stated he sees many cars being
stopped for speeding, however, has not observed any commercial vehicles
being stopped. Michael stated that
people are getting tired of all the State Police traffic stops. Craig replied that the simple solution
is for people not to speed. Craig
further discussed the need for traffic enforcement in Masonville. Craig has personally observed many
flagrant speeding violators and has fielded many speeding complaints from
constituents.
- Steve
Tiska inquired why the resolutions are not written into the Town Board
minutes. He would like to see them
in the minutes, rather than being attached. Craig said it is too cumbersome to place resolutions in
their entirety in the minutes. The
title of the resolution is listed and the actual resolution is
attached. This is proper and
legal.
- Ernst
Keidel reported that the CEO has been doing an outstanding job supervising
the work of his new house replacement.
He reports Joe has been constantly on-site ensuring the work being
done is proper and according to code.
- Judy
Jackson inquired about numerous power outages over the past few
months. Craig explained that NYSEG
has advised that a problem with a transmission line feeding the Town has
been repaired.
HIGHWAY REPORT:
- The
painting of the Town Shed has been finished.
- Patching
Potholes
- Replaced
oil pan, exhaust and the oil cooler on Truck #2
- Completed
Culvert replacement on Teed Road
- Worked
on widening and reconstruction of Teed Rd.
- Box
culverts for FEMA projects on Clark Road and Pine Swamp have been ordered.
- Bids
for a new bridge on Butts Road should be left out in early spring
- Plow
frames have been put on the trucks
- Hauling
sand to fill the storage shed
- Sent
wheels from dismounted tires from junk days for scrap-$450.00
- Picked
up waste oil from several locations
- The
Towns excavator was used over 250 hours this year on many FEMA projects
and regular maintenance work. This would have cost over $25,000 to hire
out.
- Need
to advertise list of seasonal road closures – same roads as last year.
OLD BUSINESS:
- Craig
reported on a motion later to be discussed later in the meeting for the
Dog Shelter agreement.
- Craig
reported (4) properties being listed as health hazards in the Town. George will report on this during
committee report-outs.
NEW BUSINESS:
- Craig
discussed the 2008 budget and shared the 2008 tax rates per thousand.
COMMITTEE REPORT:
- George
asked the Board’s approval to move forward with the permitting process for
fireworks in the Town. He would
like to send the draft law to the Town Attorney. The Board approved.
- George
stated he had a proposal from Attorney Arron Dean to handle the Town’s
Health Hazard complaints. Craig
stated that Frank is also working on a proposal. Both can be considered.
He will report out next month.
- George
reported that the CEO has finished his report on the inspection of the
Town Hall. The Supervisor and
Board will be working on corrective measures.
- George
reported he is finalizing the warning letter to be given to property
owners regarding failed septic systems.
This will be discussed/reviewed again at next month’s meeting.
- George
reported that the comprehensive master plan survey should go out any day.
George said that he hopes community folks would take the time to complete
and mail this survey. The Board is
really counting on the survey to finalize an appropriate Master Plan.
- George
reported that the next comprehensive master plan survey committee meeting
will be on November 29th at the Masonville Church at 7:00 P.M.
RECOMMENDED MOTIONS:
- Upon
recommendation of the Town Supervisor; the Town Board adopt the 2008 Town
Budget. So moved by Vince Warner, seconded by George Denys, all in favor
carried. Copy of budget attached.
- Upon
recommendation of the Town Supervisor; the Town Board authorize the Town
Supervisor to enter into agreement with the Heart of the Catskills Humane
Society for the sheltering and safe keeping of stray dogs in accordance
with the provisions set forth in the NYS Agriculture and Markets Law. So
move by Vince Warner, seconded by George Denys, all in favor carried.
RESOLUTIONS:
- Resolution
#23- Support for NYS Assembly Bill no. 5333 Medicaid Fraud and Abuse
reform. So moved by Vince Warner, seconded by George Denys, all in favor
carried. Copy attached.
- Resolution
# 24- In Opposition to the issuance of Licenses and Non-Driver
Identifications to those without Social Security Numbers. So moved By
Vince Warner, seconded NY George Denys, all in favor carried.
SUPERVISORS REPORT:
- Craig
thanked Duane for his expeditious response on election night during the
power outage. The generator
allowed the elections to continue uninterrupted.
- Craig
reported that at the County Board meeting Cornell Cooperative Extension
gave a presentation and that 36 new farms have started in Delaware County.
Craig said he is happy that agribusiness is on the comeback in Delaware
County. Craig also stated that
there are low interest loans available to initiate new agribusiness.
- Craig
congratulated Kathy Ryan on her election to the Town Board. Craig stated, on behalf of the Board,
he welcomed her and looked forward to working with her beginning January
1, 2008.
- Craig
reported on the Cell Tower. Both
temporary towers are still being utilized, one being tied up in a lawsuit
in Walton. Craig also stated that
the Cellular providers are now less willing to site towers where they will
not connect with all surrounding towers in the area. Masonville does have deadzones to the
south and east of the hamlet.
However, Masonville does have a signed contact. We much be patient as this is a “gift
horse”. It’s not a matter of “if”
but more than likely “when”. Craig
stated he is a frustrated as everyone concerning the delay.
Motion by George Denys to pay all audited bills, seconded by
Doug McKown, all in favor carried.
