The Pulic Hearing on the Proposed Local Law #1, 2011-Public Nuisance Law was called to order at 7:30 P.M.

Steve Roff spoke on the proposed law and said if the Town is allready has the NYS Codes and Ordinance in place why the change?. Craig said the Town will use both and the law is needed to take care of some of the problem properties which requires more specific guidelines. Craig said we have had numerous properties we have been dealing with for years to no avail and the new law will bring an end to this.

Dave Barnes spoke on the law and this may give other Boards down the road a tool that may harm the Town. Dave spoke of problems about making noise while doing there job-there business. Jeri Brayman spoke of the same.

Craig said the the Board is trying to come up with a way to clean up the Town and deal with problems that interfere with adjacent property owner’s rights while preserving property values etc. Craig stated he is against zoning and this is not zoning. Craig said he supports our remaining industries such as agriculture, bluestone and timber and wants to ensure laws do not restrict or interfere with these industries. The Board agreed and it was decided to send the local law back to the attorney to be revised so that the language may not be misinterpreted and/or manipulated in the future.


Motion by Kathy Ryan to table Local Law #1, 2011 for revisions at this time, seconded by Mike Spaccaforno, all in favor carried.



The Public Hearing on the Proposed Local Law #2, 2011- Appointed Officer residency Law was called to order at 7:45 P.M.

Craig asked the Board to approve adding Deputy Highway Superintendent and account Clerk to the list of appointed and contractual officials. The Board agreed. Steve asked if there were job descriptions for each officer that works for the Town. Craig said no there is not and if there ever is the need then that is when it will be done.


The regular Town Board meeting was called to order at 7:55 P.M.


MINUTES:

Motion by Mike Spaccaforno to accept minutes as presented, seconded by Kathy Ryan, all in favor carried.


FLOORTIME:

  1. Curt Christensen asked about County Rt. 20 and where is it at. Craig said that due to recent flooding things have been set back but that he will check into this.

  2. Steve Tiska said that he has been doing some checking into the Towns Veterans exemption and the Towns web site still has the old Local Law. Steve says a new Law was passed in 1999 and said that this needs to be updated. Steve also asked if Linnea is aware of this. Craig said he will check into it and take appropriate action.

  3. Lorriane Kelkeisen did an energy audit on the Town and gave to the Board for review.

  4. Neita VanValkenburgh told the Board that there would be a Halloween party at the Church on October 28th starting at 6:00. Neita also said there will be a food bank collection and all donations will go to Sidney flood victims.


HIGHWAY REPORT:

  1. Pugmill paved Pine Swamp-total 1 mile

  2. Picked up a 100 gallons waste oil donation

  3. Town Hall-installed sheetrock and helped with windows

  4. Chuck attended 3 different FEMA meetings

  5. Sent truck to Village of Sidney to help with flood cleanup for 2 days

  6. Hurricane Irene- Town had mostly tree cleanup and Tropical storm Lee was minor road damage.

  7. Last month the Town talked about purchasing a truck from the surplus program, under the FEMA declaration the truck and several generators were donated to the Town at no charge.

  8. On 9-30-11 Pine Hill #1 had to be closed at the bottom due to it was under mined

  9. Chuck asked if FEMA monies could be used in 2012 work


Craig said that a separate budget line could be created to for FEMA funds.

Discussion was held on the spending of highway money. Chuck said he would rather see FEMA money designated in a special budget line and not deposited into the Highway General Fund.

Craig thanked Chuck for the way he handles his highway finances ans great job on getting the truck.


COMMITTEE REPORT:

  1. Craig read the CEO report for the Month of September

  2. Mike spoke on the Town Hall and said things are moving along nice. Mike said that the heat is 2 weeks away from being installed and the court should be operational by October 18th. Mike said that thanks to Laurie the phones have been ordered and are in ready to go.

Craig thanked Mike for all his hard work helping working with the guys, blue prints over seeing the project. Mike donated all engineering services, created all the blue prints, donated all the windows as well as other metal fabrication. Mike also has worked almost full-time on the project as site engineer/foreman….all for free of charge. This has saved the Town thousands and thousands of dollars. Craig stated the project would have never been realized without the generous assistance of Mike. Great Job.


RECOMMENDED MOTIONS:

  1. Upon recommendation of the Town Supervisor; the Town Board approve local law #1-Appointed Officer Residency Law. So moved by Mike Spaccaforno, seconded by Kathy Ryan, all in favor carried.

  2. Upon recommendation of the Town Supervisor; the Town Board approve the Union Contract with the Teamsters Union, representing the Highway Department Employees, effective 1/1/2012 through 12/31/2012. So moved by Mike Spaccaforno, seconded by Betty Scott, all in favor carried.


SUPERVISORS REPORT:

  1. Craig reminded the Board of the Budget workshop to be held on October 19th at 7:00 p.m. at the Church. Craig said the Board wll have it’s work cut out dealing with the 2% cap. We have reserves to make up the difference this year but what about next year.

  2. Craig spoke on the County level and said he sponsored a resolution requiring jail inmates to cover the cost of their own healthcare if they have private insurance. Craig said the State recently allowed counties to do this and wanted Delaware County to get on board immediately.

  3. Craig said that he is trying to get the Board of supervisors to take a stand against unfounded mandates. Craig said we should get other counties to join us in standing up and telling the State we are not going to fund unfounded entitlement programs anymore. Craig would also like to see background checks, proof or citizenship and urine screenings for all individuals receiving public assistance.


Motion by Betty Scott to pay all audited bills, seconded by Mike Spaccaforno, all in favor carried.
