The public hearings of the Town Board of the Town of Masonville was Called to order at 7:30 P.M. Regular meeting to follow.
Purpose of Public Hearing # 1 the revision to the Towns Dog Control Law.
Purpose of seconded Public hearing is the proposed Special use Road Permit.

Motion by Craig DuMond to go out of regular meeting and into excutive seesion at 7:31 P.M. for possible litigation, seconded by George Denys, all in favor carried.
Motion by Craig DuMond to go out of executive session and back into meetings at 7:50 P.M., seconded by George Denys, all in favor carried.
Public hearing #1- Dog Contol revision
Kathy Kolopchin asked about hunting dogs. George read the revision for Kathy, which excludes the legal conduct of hunting dogs from the “leash law”.
Public hearing was closed at 7:55 P.M.
Public hearing # 2- Road Permit.
Al Grust from the Town of Walton spoke on some of the problems they had in their Town due to this Rally. Problems such as oil spills, damaged lawns and electric service were reported. Al stated they saw no benefit from this road test.
Jim Hagerty also from the Town of Walton said that individual landowners are not covered and are liable if someone gets hurt.
Jared Cutting said he would like to have the rally and feels the Fire Dept. could benefit from the Rally by having a BBQ.
Enrst Keidel says he will go with popular vote. Ernst stated that the road has relatively little traffic and would like to see it stay that way.
Tracy Ramage stated she routinely travels Steam Mill Rd. and said she feels the Rally cars will not damage the road as much as the logging trucks do.
Zack Cutting agreed the logging trucks damage the road and stated the race will have little effect on the road.
Jeri Brayman said there is no place for spectators to park and voiced concerns over the Rally.
Rich Otis said that he has spent a lot of time in Masonville over the last few Months. Rich said that the Walton Hwy. Dept. report came back good indicated no damage was left on the roads. Rich said there was an oil spill but it was cleaned up right after the race.
Rich said the race is Friday and Saturday and all things would be 99% cleaned up by Saturday evening and then the rest would be Sunday morning.
Rich said all local police have been notified as well as the Masonville Fire Dept.
The Public hearing was closed at 8:45 P.M.
Craig reported on the Rally and stated as much as he would love to see any economic development for the Town, he could not support this venture. Craig stated that the risk to the Town as well as private landowners was too great and the benefit to the Town too little. Craig reported that a good number of constituents contacted him personally and overwhelmingly voiced their displeasure with the proposal. Bottom line is there is too much risk and not enough public support.
George’s reported the people who contacted him were 4 ½ to 1 against the Rally.
Kathy reported 7 people indicating they supported the Rally.
Doug stated that safety is the issue and felt there was too much liability for the Town to take the chance on the Rally.
Mike stated he was voting no after considering the effects the Rally would have on hunting and sanitation.
Motion by George Denys to accept minutes as corected, seconded by Doug McKown, all in favor carried.
FLOORTIME:
Kathy Kolopchin asked if any of the Board members went to the recent gas drilling meeting. Craig said no, however, feels he is informed and abreast of the issues surrounding the proposed gas drilling.
Bob Jackson asked that if someone were to have several violations concerning the Junk Law would they receive a separate ticket for each infraction. Craig replied they would receive one ticket for the entire violation.
Steve Tiska asked if the CEO drove around to find violations in the Town. Craig reported that violations are a “complaint driven” system and that the Town cannot afford a full-time CEO to engage in such activities. Almost every municipality, including the County, operates the same way.
HIGHWAY REPORT:
Patching potholes
Installing drainage pipes
Putting up new Town line signs where needed.

Attended Day 2 of Stream Intervention Training
Finished graveling Gifford Rd
Ditched Town Rd
Shouldered and ditched Cole Rd Spur
Rebuilt the Two hills on Butts Rd
Old F-550 accepted and paid.
OLD BUSINESS:
Craig gave an update on the USDA Grant. The application has cleared the local field office on Johnstown and has been forward to Albany for consideration. The Town should have a proposal by next months meeting.
Craig reported the the Butts Road FEMA reimbursement money has came in and the the revenue anticipation note will be paid off shortly.
Craig said that the FEMA money came in from the December 2008 ice storm and it is almost $72,000.
NEW BUSINESS:
Craig said that the Delaware River Basin Commission is looking at revamping the flood plain in this area. Craig reported this would have a devastating effect on the County. People would have to update their insurance or get new insurance if they feel into the new flood plain designation. All the FEMA maps would have to be updated costing the State millions. Furthermore, there is no State money backing this up. Craig reported that Delaware county was the only representative at the meeting in Washington DC and that the State didn’t even send a representative. Craig is proud of our County planning department and says they fight really hard for every Town’s interests concerning the NYC DEP and DRBC.
Craig reported that at a recent County Supervisor’s meeting he had the opportunity to utilize the new voting machines and found the machines to be surprisingly simple to use.
COMMITTEE REPORT:
George said the County RT 20 is finally getting done.
George read the CEO Report
Mike met with the State Code Enforcement staff regarding the Town Hall addition and the State found no major flaws with the design, only minor changes.
RECOMMENDED MOTIONS:
1. Upon recommendation of the Town Supervisor; the Town Board advertize for bids for fuel oil, at last years specifications for the 2009-2010 heating year for the Town of Masonville as well as Masonville Fire District. Sop moved George Denys, seconded by Kathy Ryan, all in favor carried
2. Upon recommenation of the Town Supervisor; the Town Board adopt the revision/additions to local law 31 of 1995; Dog Control Law. So moved by George Denys, seconded by Kathy Ryan, all in favor carried
3.Upon recommendation of the Town Supervisor; the Town Board deney the request for a Special Use Road Permit as reqested by Rally New York. So moved by George Denys, seconded by Mike Spaccaforno, all in favor carried with Board member Kathy Ryan opposed.
4.Upon recommendation of the Town Supervisor; the Town Clerk publish notice, in accordance with State Law, notice of special budget workshop meeting on October 21, 2009 at 7:00 P.M. and a Public Hearing on the Town’s proposed budget for 2010 on November 4, 2009 at 7:30 P.M. So moved by George Denys, seconded by Kathy Ryan, all in favor carried.
